For such a dedicated staff as the one at Foxconn, its employees have been taken advantage of by management. Continuous cases of mistreatment, from dangerously low pay to poisoning have shattered not only Foxconnââ¬â¢s reputation, but has damaged Appleââ¬â¢s brand name. Apple is responsible for this mismanagement, as it is encompassed within Appleââ¬â¢s immediate suppliers. Apple has participated in ethically-motivated measures to fix these cases of mismanagement while improving working conditions, but it still has a long way to go. Maintaining overseas operations has the benefits of reduced costs and consistency which outweigh the negative media coverage, reputation damage, and stakeholder retaliation. However, the stakeholder retaliation, both internal and external, is strong enough that Apple must take contingent precautions to embed Appleââ¬â¢s organizational culture into Foxconnââ¬â¢s operations. Another key aspect of contract relates to the presence of the will on the part of the contracting parties to be bound by legal relations. This is assumed to be present by default in case of commercial agreements but the same is not the case for domestic agreements (Carter, 2012). This aspect has been highlighted in the verdict of the Jones v Padavatton [1969] 1 WLR 328 case where the honourable court highlighted that in case of domestic agreements, the default assumption is that the parties lack the intention to be legally bound and only when there is evidence in contrary of the same would the contract be held as legally enforceable (Taylor Taylor, 2015). It is apparent that owing to the injury and incremental expenses of an office assistant, Rose renegotiates the contract with her landlady Holly where there was mutual consent in relation to the reduction of rent till the time Rose returns back to work. It is apparent that altering the original lease contract, there existed an incentive for Rose who would have to pay lesser rent. But at the same time, there was incentive existing for Holly also she is able to sell the vegetables grown by herself through the shop. Therefore Holly did not want that the shop should close down. Thus, the modified contract would be considered as enforceable on both Rose and Holly. Further in relation to the promise to Grace, it is apparent that the promise to pay 500 was made by Rose after Grace had already extended the help for two weeks. While for the past work, Rose has always paid Grace and hence it is appropriate to expect some compensation on behalf of Grace. However, no such evidence exists in the current case which highlights the presence on the part of the parties to be legally bound. As a result, the contract between Rose and Grace cannot be considered as enforceable. Conclusion Based on the above, it may be concluded that Rose is not entitled to make any additional payment more than 1,000 as rent to Holly for the six month period. John Keats La Belle Damn Sans Merci Analysis free essay sample
The poem begins with a forlorn and heartbroken narrator suffering from both physical and emotional pain, ââ¬ËSo haggard and woebegoneââ¬â¢ (l 6) who meets a beautiful maiden. La Belle Dame sans Merci appears to portray to readers the universal anomaly of what is known as unrequited love. In conjunction to love felt equally by two parties, unrequited love occurs when the love felt by one person is far greater than that felt by the other who is loved. The term unrequited literally means ââ¬Ënot returned or rewardedââ¬â¢. This denoted the unfairness in the balance that one expects in a love relationship when the love that one feels for another is not reciprocal. Even though the love he feels for her is pure and true, she did not have the same feelings. The only clues in La Bella Dame sans Merci that depicts whether or not the love felt by the maiden towards the knight is true, comes from the dreams of the knight when he was sleeping. In his dream he comes to the realization that the maiden is pitiless and she has no mercy. His dreams can be interpreted as if the knight subconsciously knew that the love wasnââ¬â¢t real and that the maiden had already left him, and his mind has already started shifting the blame towards her. This mentally prepares the knight for the harsh reality that he has to face as he awakes. The dream might just be his rationalization; a way of making her out to be evil in order to cope with the pain of learning his love is unrequited, and in love there is despair. Despair is the state of having lost all hope, of finding oneself unable to believe life will ever be good again. The knight in La Belle Dame sans Merci falls into despair when he learns a relationship that seemed to be just starting has abruptly ended. His situation is clear from the very first line, when a stranger finds him out in the forest and can tell just by looking at him that something is gravely wrong. The stranger sees how pale he is and, noticing he has chosen to live by a dead, frozen lake, wants to know what ails him, by which he means what has made the knight so sick in spirit. In the middle stanzas of the poem, the knight describes the romance, which meant more to him than anything that happened before it or since. The brief romance ended with the lady lulling him to sleep. Readers can assume that, comfortable and happy beside her, he expected their love to continue and even to grow when he awoke. In the real (as opposed to magical) world, the knights despair would take time to develop, because he would not know for sure that the woman he loved was gone forever. In the magical world of this poem, though, he is visited in his sleep by pale figures of noble men who describe the woman as merciless. When he wakes to find her gone, he readily believes her absence confirms the damning things the figures said about her. The poem does not have the knight looking for his lady or trying to find out why she has left; he is as certain she had no intention of staying with him just as surely as he knows he loves her. There is no hope they will be reunited, and therefore there is no hope that he can ever be happy again. His life is doomed to despair. La Belle Dame sans Merci is a ballad, a medieval genre revived by the romantic poets. Keats uses the so-called ballad stanza, a quatrain in alternating iambic tetrameter and trimeter lines. The shortening of the fourth line in each stanza of Keats poem makes the stanza seem a self-contained unit, gives the ballad a deliberate and slow movement, and is pleasing to the ear. Keats uses a number of the stylistic characteristics of the ballad, such as simplicity of language, repetition, and absence of details; like some of the old ballads, it deals with the supernatural. Keats economical manner of telling a story in La Belle Dame sans Merci is the direct opposite of his lavish manner in The Eve of St. Agnes. Part of the fascination exerted by the poem comes from Keats use of understatement. Keats sets his simple story of love and death in a bleak wintry landscape that is appropriate to it: The sedge has witherd from the lake / And no birds sing! The repetition of these two lines, with minor variations, as the concluding lines of the poem emphasizes the fate of the unfortunate knight and neatly encloses the poem in a frame by bringing it back to its beginning. In keeping with the ballad tradition, Keats does not identify his questioner, or the knight, or the destructively beautiful lady. What Keats does not include in his poem contributes as much to it in arousing the readers imagination as what he puts into it. La belle dame sans merci, the beautiful lady without pity, is a femme fatale, a Circelike figure who attracts lovers only to destroy them by her supernatural powers. She destroys because it is her nature to destroy. Keats could have found patterns for his faerys child in folk mythology, classical literature, Renaissance poetry, or the medieval ballad. With a few skillful touches, he creates a woman who is at once beautiful, erotically attractive, fascinating, and deadly. Some readers see the poem as Keats personal rebellion against the pains of love. In his letters and in some of his poems, he reveals that he did experience the pains, as well as the pleasures, of love and that he resented the pains, particularly the loss of freedom that came with falling in love. However, the ballad is a very objective form, and it may be best to read La Belle Dame sans Merci as pure story and no more. In reality, the Serbs, Croats, Slovenes and Muslims in those countries share a common Slavic ethnic origin. They view themselves today as distinct peoples, largely because of their distinct religious heritages. In contrast, people in North America consider religion mainly as part of their personal/family identity. Because of the U.S. Constitution's first amendment, and the separation of church and state, Americans don't have a single faith group associated with their national feelings. Unlike the former Yugoslavia, the Kosovo conflict has both ethnic and religious components. The Kosovo conflict is fueled by ethnic and religious differences. Ethnicity is the cause between the Serbs, of Slavic origin, and ethnic Albanians. Religion has also been a conflict between Serbs, who are almost entirely followers of the Serbian Orthodox Church, and non-Serbs, who are overwhelmingly followers of Islam and Roman Catholicism. Definition As defined on the internet, ââ¬Å"a firewall is an integrated collection of security measures designed to prevent unauthorized electronic access to a networked computer system. It is also a device or set of devices configured to permit, deny, encrypt, decrypt, or proxy all computer traffic between different security domains based upon a set of rules and other criteriaâ⬠. It is just like a wall which is usually made out of water, cement and other constituents that can stop somebody from going onto the other side or a better analogy would be a net that can let water through as an authorized item and is able to stop everything else such as fish and other sea animals. History of firewalls The term ââ¬Å"firewallâ⬠originally meant a wall to confine a fire or potential fire within a building. The firewall technology itself emerged in 1980 while the internet was still a new technology; and as the internet technology internet was growing, the firewall technology started growing along with it. Why a firewall? Think of this. Did your dad ever tell you where he kept all his money? May be he did, and you probably heard him saying or talking about a bank account too. He knows that his money is safe when it is in the bank and he can get to it anytime he wants and money cannot be taken out of his account unless he has authorized the transfers. The same way, a computer system needs protection so that the important data it contains will not be destroyed by an unauthorized person and also ensures that it will work properly. But, to really understand the importance of the firewalls, you should first know the main functions surrounding your computer. In other words, what can you use your computer for? You can use your computer to save important files in its memory(which is a kind of an electronic space where you can store data) or communicate with someone else through the internet or create documents. With all the tools gathered, your computer should be able to function properly and do all those tasks for you. Unfortunately, there are some people out there that for one reason or another, are trying every day to steal the data on your computer or make it work improperly. And, this is the reason you need a firewall; the same reason the security guard stands in from of the bank to protect the bank against robbery. Types of Firewall Firewalls can be categorized into three basic types. Packet filters Application Gateways / Proxy Stateful Inspection Packet filters This type of firewall will perform its action by inspecting everything from the internet before it gets into your computer. Now, in your house, think of packet filter firewall as a security guard. Your dad or your mom have their rules and always tell you what to do; you have to do your home work, you have to go to bed at 9pm, you have to eat vegetables or else, no dessert for you, and so on. However, they love you so much that they hire a security guard to protect you 24/7, and he will never go anywhere. Your parents also ask a security guard not to let anyone get into the house without their permission. To do so, a security guard is given a list of people who can and cannot enter the house, this list called Access Control Lists (ACLs). Application Gateways / Proxy You parents realize that one security guard is not enough, and they want to ensure that the house is a safe place for you. Your parents call the security guard company and hire more security guards. The company suggests your parents choose its best system available called Application Gateways, also called Proxy. Your parent accepted the offer; a big gate with the security room is built in front of your house in no time. Everyone who wants to get into the house will have to go through this security room and has his Identification (ID) checked. This ID can verify who he is, where he comes from, and what business he has at your house. If an ID is valid, a person will be searched to see if he carries weapons. By doing so, you can now be sure that you are safer than ever before. Stateful Inspection There is another type of body guard called Stateful Inspection. Not only will he follow Access Control Lists (ACLs) as mentioned before, but he also takes a picture of visitors to keep on record. The next time this visitor comes, he will be recognized by the picture on his file. . How the Firewall works? The major job of a firewall is to keep anything in your computer secured. It works like a traffic light. If you are driving a car or riding a bike, you start to slow down at traffic lights and come to a complete stop if the light is red. Red lights mean you are not allowed to cross, and if it is green then you are good to go. Firewalls stand in the middle between the system and the internet. It stops or alerts you if you have anyone trying to invade your personal computer space. A firewall is like a security guard standing in front of a bar checking for IDs because you have to be twenty-one years-old in order to get into the bar. A firewall stands between two networks, and the network is just like a bar. Outside a bar is a place where everybody can sit or stand regardless of how old they are. Similarly, outside the network is where all the traffic flows, bad or good. However, inside the bar are the customers who are of legal age. Compare this to your personal computer network that is not for everyone; it is only for the traffic that you want to be in your computer. The traffic has to meet certain criteria so that firewalls can allow them into your computer. Those who meet the criteria are let in by the firewall and those who do not meet the criteria are kept out. If bad traffic is enters your computer illegally, it rings a bell to let you know that something has entered inside without your knowledge. Firewall layers A firewall is working on the third of the seven layers of OSI Model. It is a network layer. This is where the traffic passes into the network. OSI stand for Open System Interconnection and it is defined as a networking structure which is responsible for implementation of the traffic within the seven layers. To clarify the function of the seven layers in the OSI Model, let us replace OSI with a house that has seven rooms: three small bedrooms for kids, a family room, a room for the family library, and two bathrooms, one for a shower and other for a toilet. These rooms each have a different use. For example, someone living in that house cannot use the shower room for a toilet. He/she has to go to the toilet room because the shower room is designed for showers only. Each of these bedrooms has its own duty too. The same thing is true of the seven layers of the OSI model. Each layer has its own duty to perform. The master room is for mom and dad to sleep. Kids are not allowed to sleep in mom and dad`s room because the function of that room is only for dad and mom to sleep. OSI layer seven`s function is to give the last computerââ¬â¢s user a service; an example would be giving an email account to a certain user. Conclusion In conclusion, we will say that the firewall technology is widely used in the world of technology today. Firewalls appear sometimes as one component or as a combination of components that are really sophisticated in order to meet the requirements and to protect the user against the continuing threats from the internet world.
